AFOA
EDUCATIONAL PROGRAM
MARCH 15,
2007...Nationwide Teleconference 7:00 PM Central Time.
TOPIC: Private Landowner Liable for Hunter’s Actions. SPEAKER:
Mark W. Thomas, Forestry/Wildlife Integration, LLC.
Mark was an expert witness in a lawsuit involving a
shooting accident. The landowner (who gave permission to hunt) might end up paying
as much as a $1 million to settle the claim. Mark will suggest ideas to
help us avoid similar predicaments. AFOA insurance agent Ed Wilson,
Davis-Garvin Agency, Inc., commented after the program that AFOA's
Timberland Liability Group Insurance Policy would have covered the
landowner in this case. AFOA's Hunting Lease Liability Group Insurance
Policy could also have been used to cover both the landowner and the
hunter in this case if the relationship had been of a long-term nature
(such as a 1 year agreement to allow the hunter to use the property for
hunting).
AFOA members would be wise to tell every hunter given permission to
hunt on their land to
A. Follow the Laws of the State of Alabama (or the
state where the land is located)
B. Be Careful
C. Use Common Sense

year and provide feedback to him on problems or opportunities they discover when
using the software. There is no charge for participating. However, after the
testing period is over, users will have to pay a license fee of about $1,000 to
